Texas Attorney General sues Biden administration after federal agents cut razor wire on the border

Texas Attorney General Ken Paxton is suing the Biden administration for what the state calls intentionally destroying parts of a border barrier erected by the Texas National Guard.The lawsuit comes after reports and videos surfaced last month showing that U.S. Border Patrol agents have cut strands of concertina wiring installed as part of Texas Gov. Greg Abbott's Operation Lone Star. That multi-billion, state-led border mission began in 2021....

Texas Attorney General Ken Paxton is suing the Biden administration for what the state calls intentionally destroying parts of a border barrier erected by the Texas National Guard.

The lawsuit comes after reports and videos surfaced last month showing that U.S. Border Patrol agents have cut strands of concertina wiring installed as part of Texas Gov. Greg Abbott's Operation Lone Star. That multi-billion, state-led border mission began in 2021.

In one video, agents cut portions of the barrier on the northern banks of the Rio Grande in Eagle Pass, an area that has seen a record number of unauthorized crossings this year. Abbott posted a different video on social media, commenting that federal agents were "opening the floodgates to illegal immigrants."

Federal agents have pushed back against those claims and said wire and other obstacles prevent Border Patrol from doing its job, adding that they also need to consider migrants' safety.

U.S. Border Patrol Chief Jason Owens told Reuters last month that his agents have the right to remove barriers if necessary.

"If they start getting swept away by the currents, if they start succumbing to the environment — the extreme temperatures, the humidity you all feel right now — and my men and women see that, they are not going to let somebody die or get into harm’s way,” he said.

In his filing Paxton said that the federal agents were "undermining Texas's efforts to stem the flow of illegal immigration."

"By cutting Texas's concertina wire, the federal government has not only illegally destroyed property owned by the State of Texas; it has also disrupted the State's border security efforts, leaving gaps in Texas's border barriers and damaging Texas's ability to effectively deter illegal entry into its territory," the filing states.

Paxton is asking a federal judge to order agents to stop the practice. The lawsuit was filed Tuesday in federal court in Del Rio and names Owens, Department of Homeland Security Secretary Alejandro Mayorkas, acting CBP Commissioner Troy Miller and acting Del Rio Border Patrol Sector Chief Juan Bernal as defendants.

The lawsuit is the latest in the state's ongoing battle with the federal government over border security. The two are currently battling in court over the legality of 1,000 feet of a floating barrier Abbott ordered installed in the Rio Grande at Eagle Pass. The buoys come equipped with large, circular saw-like blades and are anchored into the ground, which opponents argue can endanger asylum seekers trying to reach U.S. soil. The federal government has argued in court that the buoys violate international law since the Mexico also shares the Rio Grande. The buoys are still in place while the lawsuit is pending before the Fifth Circuit Court of Appeals.

With the XFL and USFL combining forces to form the new United Football League, it was assumed Houston — the only market with a team in both the XFL and USFL — would be a part of it. It will, as the Houston Roughnecks, but it will do so without head coach Wade Phillips, who is hitting Interstate 10 to lead the league's San Antonio Brahmas.

Phillips — the son of legendary Oilers coach Bum Phillips and former head coach of the Broncos, Bills and Cowboys — led the XFL's Houston Roughnecks to a 7-3 record in 2023 before the creation of the UFL.

The new Houston Roughnecks will be coached by C.J. Johnson, who led the USFL's Houston Gamblers to a 5-5 record last season. The 62-year-old Johnson coached in college and the NFL for 35 years, including four seasons as Tulane's head coach when he took the Green Wave to its first bowl game in 11 seasons in 2013. He also won a Super Bowl as the Saints receivers coach.

The UFL will have eight teams split into two conferences: USFL and XFL. The Houston Roughnecks will play in the USFL Conference along with the Birmingham Stallions, Memphis Showboats and Michigan Panthers. The XFL Conference will include two other Texas teams — the Arlington Renegades and San Antonio Brahmas — who will join the St. Louis Battlehawks and D.C. Defenders.

Even though the Houston team will be playing in the USFL Conference and be led by the USFL team's coach, it is using the Roughnecks name from the XFL. The Roughnecks won the XFL South last season before losing to the eventual champion Arlington Renegades in the first round of the playoffs. The Roughnecks played their home games at University of Houston's TDECU Stadium, averaging 11,768 fans per game. That was sixth in the eight-team league with only the St. Louis Battlehawks averaging more than 15,000 fans.

Before Johnson took over last season, the Houston Gamblers went 3-7 in 2022, their first and only season under former UH and Texas A&M coach Kevin Sumlin, who left after one year to take a job as assistant head coach at University of Maryland. The USFL used a hub system with teams practicing and playing games in places unrelated to their affiliated city. In 2022, all eight teams played their games in Birmingham, Alabama. Last season was split between four host cities with the Gamblers playing their "home games" in Memphis, Tennessee.

Stadium locations for teams in the UFL haven't been announced, but fans already can make deposits on season tickets with the expectation that each team will play in its home market.

The full season schedule also hasn't been released, but each team will play 10 games starting with the XFL champion Arlington Renegades facing the USFL champion Birmingham Stallions in the league's debut March 30. All teams will have training camp in Arlington beginning Feb. 24.

Every coach in the new league was in the XFL or USFL last season with five of the eight coaches remaining with the same team: Arlington's Bob Stoops, Michigan's Mike Nolan, Birmingham's Skip Holtz, St. Louis' Anthony Becht and D.C.'s Reggie Barlow. John DeFilippo, who coached the New Orleans Breakers in the USFL, will lead the Memphis Showboats. Phillips replaces Hines Ward in San Antonio.

Former XFL president Russ Brandon will hold the same title in the UFL and former Cowboys fullback Daryl Johnston, who was the USFL's president of football operations, will lead the new league's football operations.

The UFL lists five league "partners," including the three former XFL owners: Gerry Cardinale, Dany Garcia and former professional wrestler Dwayne "The Rock" Johnson. Fox Sports and ESPN, which ran the USFL, also are listed as league partners.

The Texas Supreme Court has sided with former top deputies of Attorney General Ken Paxton and cleared the way for their whistleblower lawsuit to move forward.

The all-Republican Supreme Court on Friday rejected Paxton’s request to dismiss the lawsuit after the case had been on pause pending a possible settlement with the whistleblowers. The decisions came four days after the whistleblowers asked the court to reinstate the case — and about two weeks after Paxton was acquitted in his impeachment trial before the Texas Senate.

The lawsuit will return to a Travis County trial court.

"We are looking forward to obtaining a trial setting and to preparing this case for trial as soon as possible,” the whistleblowers' lawyers said in a statement.

Four whistleblowers sued the attorney general's office in 2020 for wrongful termination and retaliation after they reported Paxton to the FBI, alleging he abused his office to help a friend and donor, Nate Paul. They almost settled with the attorney general’s office for $3.3 million earlier this year — until Texas House investigators, concerned about using taxpayer dollars for the settlement, started probing the lawsuit’s claims and recommended Paxton’s impeachment.

The series of events effectively froze the case at the Texas Supreme Court. But on Monday, the whistleblowers held a news conference to announce that they were asking the high court to jump start their case in light of Paxton’s acquittal.

“The political trial is over, and it’s time for the case to return to a real court,” whistleblower Blake Brickman said Monday.

Paxton’s office declined to comment on the news conference, saying only that its lawyers would respond in court. But it appears they did not file a reply prior to Friday’s ruling.

Brickman is a plaintiff in the lawsuit with three other former Paxton deputies: Ryan Vassar, David Maxwell and Mark Penley. The four fired deputies testified as prosecution witnesses at Paxton’s impeachment trial.

The Supreme Court provided no explanation for its decision Friday, noting only that Paxton’s petition for review was denied with Justice Evan Young not participating.

The case reached the Texas Supreme Court in early 2022, after a state appeals court and the trial judge rejected pretrial attempts by Paxton’s agency to dismiss the lawsuit.

The Texas Whistleblower Act protects state workers from retaliation by other employees for reporting potential crimes to law enforcement. Paxton has argued his agency acted properly because it has the right to fire employees “at will” and because the whistleblower law does not apply to Paxton because he is an elected official, not a “public employee.”

“Like the Governor, the Lieutenant Governor, and members of this Court, he is an elected officer, chosen by the people of Texas to exercise sovereign authority on their behalf,” Paxton’s office said in its petition for review to the Supreme Court.

Paxton’s office did not immediately respond to a request for comment on Friday’s ruling.
