Ashlye Robinson, who lives in the Houston area, says she was checking on squawking bird when the snake 'jumped' in.

FRESNO, Texas — Ashlye Robinson recently sent a wild video into KHOU 11 that shows her encounter with a snake at her Fresno home.

Robinson explains she kept hearing a bird squawking at her front door, and when she opened it, a snake fell in.

She says she thought the bird was making noise because her puppy was harassing it, but that wasn't the case.

"...no, it's not. A snake jumped — literally jumped in my door when I opened it, and it scared me so bad that I jumped back and closed the door," she says.

The video shows the snake, later realized to be a harmless, non-venomous rat snake, curled up in a corner near the door, next to a broom.

"My brain was just like run away," Robinson said.

Robinson says she was able to get the snake back outdoors on her own using a broom, which the snake tried to attack. She then called in a cruelty-free animal expert to remove the animal from her property.

"She was frantic," Jordyn Martinez said laughingly.

They are joking now, but in the heat of the moment the snake sacred Robinson half to death.

"I refused to turn my back on it because I have little kids and I knew if I turned my back on him, I'd probably never find him again in this house," she said.

Recently, snakes have been spotted in the strangest of places.

"I got up in the middle of the night to go to the bathroom," Patty Tidwell said. "I opened my bathroom door and turned around and there was this big python on the back of my toilet."

From a West Texas bathroom to a bank off Highway 290 at Fairbanks where an AC repairman changing filters came face-to-face with a 6-foot rattlesnake, snakes have been active this summer.

"Had me pinned on one side and he was blocking me to get to my ladder," said Jesse with Kleen Air Services. "I called the bank and the bank called 911."

Back to Robinson and Martinez’s snake story.

"Maneuvered him to the front door," Robinson said. "Kept pushing him and kept pushing until he was out the front door. And he was like oh this is outside."

Martinez, a 17-year-old high school senior with a snake side hustle, relocated the rat snake.

"It was just snake show and tell," Martinez said.

"She was so gentle with him and totally calmed down the whole situation and she even had a little box for him," Robinson said.

"Where's the snake now?" asked KHOU 11’s Xavier Walton.

"State park," Martinez said.

19 Venezuelan migrants were bused into Fresno on Saturday from Texas. Among the 19, there are families and at least three children.

FRESNO, Calif. (KFSN) -- Cities around the country have been facing an influx of migrants from the Southern border, many coming from Texas. Now Fresno is the latest major U.S. city to receive a group.

"This was thrust upon us. If we would have had some notice from someone," Fresno Mayor Jerry Dyer said. "We would have been prepared to receive them and go through a more organized process."

At City Hall on Friday afternoon, the 19 asylum-seekers from Venezuela were provided with resources and soon a health screening.

Councilmember Miguel Arias and Mayor Jerry Dyer say support is happening at the last minute since they had no idea the Venezuelans were in Fresno.

"We have been able to secure legal council members for them, social services support, and some housing," Arias said.

The migrants were dropped off over the weekend by a Greyhound bus. Some say Fresno was not their final destination.

"They originally were in El Paso, placed on a bus. They were given the option as to what city they wanted and they picked Denver but once they got they, they were bused back to California," Dyer said. "And according to them they thought they were going to Indio and ended up in Fresno."

The families say that after arriving, they were pointed to the Fresno Mission.

Matt Dildine, the non-profit CEO, confirms they provided services for them Thursday. Dildine says he's already receiving backlash from his donors, for helping out the migrants.

"We are not a political organization. We are not border patrol. It's our job to reflect Christ, which is what we are trying to do," Dildine said.

The families are now in a hotel and will stay there temporarily while the county steps in to help.

Dyer understands buses carrying migrants from states have been sent to other parts of the country and says what's happening needs a solution.

"I do not support what is being done in Texas by shipping seekers all over but I understand what they face in Texas and Arizona where there is an influx of people coming into the state," Dyer said

On Saturday morning, Social Services will be meeting with the families.

Mayor Dyer says they will help the 19 migrants get back to El Paso where they have a court date to continue with their immigration process.

A popular barbecue joint in Fresno is asking for help.

And in typical fashion, the owners of Mega Texas Barbeque are going about things in a unique way.

Mega Texas Barbeque, whose popularity skyrocketed four years ago by serving up great tasting smoked ribs and bacon-wrapped chicken oddly out of a gas station, is on the verge of moving out of the Arco in central Fresno and opening its own restaurant.

But to open the doors at their new spot with the decor and service standard that owner Anthony Vallejo envisions, he and co-owner wife Tasha have set up a GoFundMe page asking for additional money to help “reach our dreams.”

“When people would ask ‘When are you getting your own place?’ we replied ‘When we find the right spot,’“ the Mega Texas GoFundMe page reads. “Now that we have found a permanent home for MEGA Texas BBQ, this isn’t just a place for us, but a place for everyone!

“The space is everything we have dreamed of in a location.”

Added Vallejo: “What we’ve been trying to create has always been more than just eating barbecue. When you think about the history of barbecues, that’s traditionally reserved for special occasions.

“With this restaurant, we want to help create that experience of how barbecue makes people happy and brings us all together.”

The new Mega Texas Barbeque restaurant, which is expected to open later this month, is located on the outskirts of downtown Fresno at the corner of Orange and Butler avenues.

Unlike other barbecue places in the Central Valley, Mega Texas Barbeque offers Texas-style BBQ food that’s been smoked low and slow.

Not grilled hot and fast, which can sometimes lead to tough meats.

“Texas inspired, California fired,” the Mega Texas Barbeque slogan reads.

They also barbecue their food the day of order — rather than grilled previously and reheated just before order as other barbecue places sometimes do — to provide customers meats that are fresh, tender and flavorful.

Vallejo expressed confidence that the mom-and-pop establishment could open without the GoFundMe donations.

But the additional money would go a long way toward decorating and furnishing the new establishment, as well as hire more employees, Vallejo said.

In about a week, the Mega Texas Barbeque page had raised almost $3,200. The donation goal is set at $10,000.

For several days, Vallejo struggled with the idea of going public and asking donations from his customers and social media fans.

Mega Texas Barbeque has more than 23,000 followers on Instagram alone, which is slightly more than even Dog House Grill — the restaurant many consider Fresno’s most popular.

The Mega Texas GoFundMe post generated a mix of reactions: some critical, some sympathetic and others full-on supportive.

“This wasn’t something we came to easily,” Vallejo said while getting emotional during an interview with The Bee from his new restaurant location. “I’ve never been a person to ask for help. It’s the last thing I wanted to do.

“The fact that there is judgment from others when asking for help, that’s hard. That’s difficult.”

Tasha, Vallejo’s wife and often the greeter and cashier at Mega Texas Barbeque, eventually convinced her husband to swallow his pride.

She reminded Vallejo of the times Mega Texas Barbeque helped others in the community.

Like giving free food to barbers, hairdressers and tattoo artists who were out of work because of COVID-19 pandemic restrictions and shutdowns.

Maybe this time, people could help Vallejo?

“Regardless (of the donations), we’re going to open,” Vallejo said. “It may not be exactly how we want to. But we’re going to make it happen.

“We’ve got a pretty good thing going. We’re asking for a little help to take us to another level.”

Located at 3598 E. Butler Avenue (where Javence Pizzeria was previously), the new Mega Texas Barbeque location is in a less visited area compared to its current spot at the intersection of Fresno Street and McKinley avenue in central Fresno.

But their new place still is less than two miles from highly frequented spots such as the Fresno County Courthouse, Chukchansi Park and the Fresno Fairgrounds.

The new location also will have more parking, offer indoor and outdoor seating, and in time, could allow Mega Texas Barbeque to be open more often.

Mega Texas Barbeque currently is open Thursday through Saturday. And while they have a listed time of 10 a.m.-2:30 p.m. of being open, they will close earlier if they sell out of food sooner.

Vallejo also envisions the new restaurant location eventually being open for breakfast and offering another popular Texas dish — breakfast tacos.

“Everyone says ‘You’re going to kill it,’ “ Vallejo said. “And I think we will, too. But it’s getting that door open and doing it the right way.

“I believe in our food. I believe in the service we will provide. And I believe in what this restaurant will do and can become.”

UPDATE 10:30 P.M.: A Fresno judge has issued a temporary restraining order against Bitwise Industries and subsidiaries freezing bank accounts related to a lawsuit filed this week by Texas company NICbyte LLC over properties in Fresno, Bakersfield and Oakland.

Fresno County Superior Court Judge Jeffrey Hamilton signed the order Wednesday afternoon. It locks up five separate bank accounts, each belonging to a Bitwise affiliate company controlling the five pieces of property. It also orders the company to “immediately cease, desist and stop all sale efforts of all five of the properties ….”

Additionally, Hamilton’s order requires one of the Bitwise subsidiaries, Wishon Row LLC, to turn over to NICbyte “all books, leases and records” related to the five properties, and from “diverting or using any of the rents from the properties for purposes unrelated to the properties or management of the properties. …”

The temporary restraining order will be in effect through June 17. In the meantime, Bitwise Industries co-CEOs Jake Soberal and Irma Olguin Jr. and Bitwise subsidiaries have been ordered to show cause why the court should not impose a preliminary injunction that would extend the conditions of the temporary restraining order while the lawsuit is pending.

ORIGINAL STORY:

A Texas company is filing suit against Bitwise Industries and a collection of affiliate business enterprises alleging breach of contract and other financial misdeeds related to Bitwise properties in Fresno, Oakland and Bakersfield.

NICbyte LLC asserts in the lawsuit, filed Tuesday in Fresno County Superior Court, that it is an 95% majority investor in a joint agreement with Bitwise and several of its subsidiaries, following a contribution of almost $35.5 million to the venture that owns five Bitwise buildings.

The lawsuit alleges that Bitwise illegally borrowed almost $30 million in loans using the buildings as collateral, and also listed four of the five properties for sale without legal authority to do so.

And it’s at least the second lawsuit against Bitwise over the old State Center Warehouse building in downtown Fresno.

The lawsuit comes on the heels of Bitwise co-CEOs Jake Soberal and Irma Olguin Jr. announcing late Monday that the company had furloughed all of its employees in Fresno and other locations in California and the U.S. Soberal said the company had about 900 employees across the country.

Attorneys for NICbyte state that the Texas company entered the joint venture with Bitwise subsidiary Wishon Row LLC, in June 2022 “for the purpose of acquiring five real properties in Fresno, Kern and Alameda counties.” According to the suit, NICbyte contributed 95% of the money needed for the deals.

All five of the acquired properties were previously owned or controlled by BW Industries Inc., a holding company for the wide array of Bitwise operations. BW Industries subsequently leased the buildings back from the joint venture.

But, the lawsuit alleges, Wishon Row “has breached the joint venture agreement in myriad ways since the early days of the joint venture, including:

“Only on May 26, 2023 did plaintiff discover the true extent of (Wishon Row’s) bad acts and material breaches,” NICbyte attorney Stephen Sutro wrote in the court document.

From December 2022 through March 2023, the lawsuit alleges that Wishon Row entered into loan agreements secured by the various properties owned by the joint venture. Those loans amounted to almost $30 million. “The loans were entered into without NICbyte/Investor’s required approval or consent …,” the complaint states, “meaning (Wishon Row) lacked the legal authority to do so.”

“In fact, (Wishon Row) failed to even disclose these actions and did so secretly and for its sole benefit — not for the benefit of the joint venture,” the lawsuit adds.

The actions by Bitwise and its subsidiaries “have put (NICByte) at risk of losing nearly its entire investment amount,” the suit alleges. “NICByte/Investor does not have any knowledge as to where the loan proceeds have gone, whether (Wishon Row) still possesses them, or if they even still exist.”

As a tenant of each of the buildings under the joint venture, BW Industries is responsible for paying property taxes and other costs. The lawsuit alleges that BW Industries is delinquent and owes more than $32,000 in property taxes on three sites in Bakersfield, more than $63,000 for the former State Center Warehouse property on R Street near Ventura Street in downtown Fresno; and more than $35,000 on a building and property in Oakland.

The lawsuit seeks a restraining order and injunctions against the various Bitwise enterprises to freeze transactions for accounts associated with Wishon Row and other BW Industries enterprises involved in the property ownership; to immediately order that the four properties listed for sale be taken off the market and any potential sales blocked; to prevent the Bitwise enterprises from damaging or disposing of any fixtures on the properties, or collecting and diverting rents; and taking any action to “impair the preservation of the properties.”

Soberal, one of the co-CEO for Bitwise, did not immediately respond to text messages from The Fresno Bee seeking reaction to the lawsuit.

Ascendant Development, a Houston-based multifamily real estate development and construction firm, has broken ground on Preserve at HW6, a 320-unit, single-family build-to-rent community in Fresno, Texas. Preleasing is expected to begin in fall 2024 for the BTR property in the greater Houston area.

Located at 11923 State Highway 6 in Fresno, Preserve at HW6 will have one-story, detached single-family homes ranging in size from one-bedroom residences with 763 square feet to three-bedrooms with 1,388 square feet. Each home will feature luxury vinyl plank flooring, energy-efficient LED lighting, granite countertops, modern backsplashes, under-mount sinks and energy-efficient appliances. The residences will have property-wide Wi-Fi and smart unit technology. Detached garages will also be offered at the site.

Community amenities will include an expansive clubhouse with a gourmet kitchen, fitness center with yoga and spin room, game room and club room. Outdoor features will include a resort-style saltwater pool, central park for residents and dog park. Entertainment, shopping and dining options are available within minutes of the community, according to Richard Owen, principal & co-founder.

Growing portfolio

Owen said in a prepared statement the Preserve at HW6 is an example of Ascendant’s strategy to tailor its developments to the demands of the particular submarket. Pointing to the high barriers to entry in the Missouri City/Sienna Plantation area, Owen said they believe Preserve at HW6 will be a successful addition to the firm’s growing build-to-rent portfolio.

David Kulkarni and Owen formed Ascendant Development last year to focus on development of Class A luxury multifamily communities throughout the United States. The firm is focusing on high-growth areas with strong organic fundamentals including Houston, Dallas and Austin in Texas as well as Phoenix; Nashville, Tenn.; and Las Vegas, Nev.

The two principals have an extensive track record in commercial real estate and have developed more than 4,500 units and $1 billion in real estate value in the multifamily sector including luxury Class A multifamily and student housing properties. Currently, Ascendant has a pipeline of more than 3,600 units in various stages of development and is actively seeking additional development and partnership opportunities. In December, Ascendant began construction of Haven at Treeline, a 231-unit, luxury garden-style apartment community in Tomball, Texas. Located in Harris County, Tomball is also in the greater Houston metro. The property, which will have seven three-story garden-style buildings, is expected to begin preleasing in summer 2024. Haven at Treeline will also have a modern clubhouse, resort-style pool and outdoor amenity suite.
