Fort Bend County, city of Arcola battle over land annexation agreement

The small city of Arcola, about 25 miles south of Houston, is in the midst of a legal dispute with Fort Bend County and a municipal management district.The dispute centers on an 83-acre tract of land off Fenn Road, west of Arcola, where a developer plans to build 350 single-family homes.The city is trying to de-annex the land, and the management district and county are suing to stop them.Arcola annexed the land in 2021. The small city of Arcola, about 25 miles south of Houston, is in the midst of a legal dispute with Fort Bend County and a municipal management district.

The dispute centers on an 83-acre tract of land off Fenn Road, west of Arcola, where a developer plans to build 350 single-family homes.

The city is trying to de-annex the land, and the management district and county are suing to stop them.

Arcola annexed the land in 2021. Both the city and the county agreed to pay 85% of their taxes from the area to the Arcola Municipal Management District No. 1.

In exchange, the management district would use the funds to build public infrastructure for the area.

Now, the city wants out of the deal. In court documents, they argue that the annexation is void because the land isn't adjacent to city limits.

During a July meeting, Arcola Mayor Fred Burton said he felt it was unfair that the city would only receive 15% of the tax revenue for the property, under the initial deal.

"We could do better for this community at this time than what's being offered to us," he said during the meeting. "We could do better."

Burton did not return requests for an interview.

The management district and the developer said the city has used the threat of de-annexation to try to get them to finance additional public works projects that are outside the scope of the development.

Compass Land Development, which plans to develop the land, is not involved in the lawsuit. Nino Corbett, president of the development company, said in a statement that the development is "well worth fighting for."

"There is a lot on the line right now in Arcola — critical infrastructure, loss of meaningful net profit to the City, and an end to development of new communities ... within the City of Arcola all hang in the balance," he said in the statement.

Joel Cleveland is an attorney at the Muller Law Group, which is the management district's general and bond counsel.

"I don't see any reason why this deal should fall apart," he said. "I do think it would be bad for the management district, bad for the city, bad all around."

Fort Bend County Attorney Bridgette Smith-Lawson did not respond to requests for comment.

The lawsuit remains ongoing.

Rome wasn’t built in a day, and droughts don’t end in a day. Usually. But, hey, for the third day or so in a row, we have rain chances on the menu today. Are they high rain chances? Not especially. But expect at least some scattered showers or isolated thunderstorms with downpours. The best odds may be to the south and west of Houston. As has been the case this week, those downpours could add up quickly in spots and cause some brief street flooding. We will watch to see if perhaps a more vigorous disturbance could produce a more organized area of storms at some point later today to deliver a little more widespread rain. But that is not certain.

Clouds will keep temperatures in check in spots. With rain, expect upper-70s to low-80s. With sun, expect near 90 degrees or a little hotter, with plenty of humidity to boot.

Look for yet another day with rain chances. Again, many folks will see nothing. But just the fact that we have strung together multiple consecutive days with showers in the area is nice to see again. Anyway, I think the focus of rainfall tomorrow may be south of I-10 or southeast of Hwy 59/I-69 and toward the coast. But we’ll see. Expect morning lows in the 70s and highs of about 90 degrees or so.

I would go forth with whatever plans you have Sunday without worrying too much. There will be a slight rain chance, especially toward the coast as a weak front pushes offshore. This should lower the humidity some and allow us to peak in the low-90s after a morning in the 70s.

The good news is that the Sunday front will actually yield a relatively pleasant morning Monday and perhaps Tuesday. Look for morning lows around 70 or so (with a few spots in the 60s) followed by daytime highs in the low-90s.

Temperatures heat back up for the middle and end of next week and we may temporarily see rain chances return. We continue to see virtually no sign of a legitimate autumn cold front over the next 10 to 14 days. So late summer continues, perhaps into the end of September.

Voters have approved the Texas property tax relief package (Proposition 4) lawmakers agreed to over the summer. The compromise between Texas lawmakers, which came after many months of disagreement, includes an increased homestead exemption and property tax cuts for businesses and homeowners. Now that Texans have approved the measure, those exemptions and cuts will become effective this year.

“Today, we will deliver even more with over $18 billion in property tax cuts,” Texas Gov. Greg Abbott said in statement regarding the property tax deal.

Texas property tax relief for homeowners

The property tax relief package includes tax cuts through compression (providing more funding to school districts so schools can cut taxes for homeowners), which was a priority for Gov. Abbott. Tax compression began in 2019, but the new tax deal will provide an additional savings of 10.7 cents per $100 valuation ($107 per $100,000 valuation).

An increased homestead exemption, which was a sticking point for Texas Lt. Gov. Dan Patrick, also made it into the final deal. Since the deal is now official, the Texas homestead exemption will more than double, from $40,000 to $100,000.

This could be helpful for some residents because it means an additional $60,000 of a property’s taxable value will be exempt from property taxes.

Circuit breaker tax credit

Homeowners and businesses may be eligible to claim a circuit breaker tax credit. That tax credit essentially limits how much property taxes can increase in a certain period in Texas.

The credit will also be available to non-homestead properties (properties that are not the owner’s primary residence) and will cap yearly appraisal increases at 20%. The program could provide tax relief for small businesses, which was a priority for Gov. Abbott.

Unlike circuit breaker programs in most other states, the new Texas credit will not be based on income or age.

Texas franchise tax

Texas already exempts businesses making less than $1.24 million from paying the state’s franchise tax. But one of the bills included in the property tax relief package will nearly double the exemption to $2.47 million.

The newly approved legislation will eliminate Texas franchise taxes for roughly 40% of small and medium-sized businesses, according to state Sen. Paul Bettencourt (D-7), one of the Texas legislators who filed the bill.

When Texas property taxes will go down

Now that voters have approved the property tax deal, homeowners could begin to see savings on 2023 property taxes, which will be reflected in their tax bills due in January 2024.

Ascendant Development, a Houston-based multifamily real estate development and construction firm, has broken ground on Preserve at HW6, a 320-unit, single-family build-to-rent community in Fresno, Texas. Preleasing is expected to begin in fall 2024 for the BTR property in the greater Houston area.

Located at 11923 State Highway 6 in Fresno, Preserve at HW6 will have one-story, detached single-family homes ranging in size from one-bedroom residences with 763 square feet to three-bedrooms with 1,388 square feet. Each home will feature luxury vinyl plank flooring, energy-efficient LED lighting, granite countertops, modern backsplashes, under-mount sinks and energy-efficient appliances. The residences will have property-wide Wi-Fi and smart unit technology. Detached garages will also be offered at the site.

Community amenities will include an expansive clubhouse with a gourmet kitchen, fitness center with yoga and spin room, game room and club room. Outdoor features will include a resort-style saltwater pool, central park for residents and dog park. Entertainment, shopping and dining options are available within minutes of the community, according to Richard Owen, principal & co-founder.

Owen said in a prepared statement the Preserve at HW6 is an example of Ascendant’s strategy to tailor its developments to the demands of the particular submarket. Pointing to the high barriers to entry in the Missouri City/Sienna Plantation area, Owen said they believe Preserve at HW6 will be a successful addition to the firm’s growing build-to-rent portfolio.
